
I deny this debt is my responsibility and refuse to pay it. I would send a FOAD letter stating that I have not had cellular service with Sprint in over a decade. I reported ERC to them and they backed down FAST. They are based in Florida and have numerous complaints with the Florida Office of Financial Regulation. I had to deal with them about 10 years ago for a similar reason over a DirecTv bill. If they are aware that the exclusion period has expired and nonetheless make threat of posting to your credit report, that would be a misrepresentation under FDCPA 809 or 809 and subject then to civil action for violation of the FDCPA.Īs an alternative, you can simply send them a cease communication notice under the provisions of FDCPA 805(c), which prevents them from any further communication, and forget is a credit report poisoner. The DV process does not set any period for response or even compel any response. One such attempt might be to send the debt collector a debt validation request, but that wont compel them to do anything except ceasing continued collection activities until they have first sent validation. If you dont recognize the legitimacy of the debt but feel obligation to determine its legitimacy and pay if you find it to be a legit debt, then you can always pursue attempts to first verify the debt. I have turned the house upside down looking for any old Sprint bills that I might be able to use but I cannot find any. I also dont want to do anything stupid that might accidentally restart the clock over again I know I can submit a debt validation request to them, do you know if they are required to put the date account was closed? We were hoping to list our home this summer and buy another that better suits our family. I am worried sick over it, and losing sleep at night trying to figure out what to do.

I have great credit and a squeakly clean report that I worked hard on for years. This is several years passed the statute of limitations on both suing and credit reporting. This is well passed the 7 year reporting allowance. Now this company sends me a letter stating if I do not pay within 30 days they will report it on my credit.

Sprint never once placed this on my credit report. I have used a prepaid company ever since. I had Sprint for 7 years, however I left them in early 2011. They state that they are attempting to collect a debt from Sprint for $500 but of course want to settle for much less.
